Equal Political Speech

Rich will sponsor a Joint Resolution to seek Ratification of a 28th Amendment to the U.S. Constitution when elected to Congress. Section 3 below provides natural persons the exclusive right to political speech under the law. In other words, if you cannot vote in an election, you cannot contribute to political campaigns in the election:

Other proposed 28th Amendments do not create a right to "equal political speech" that expands the Bill of Rights under the U.S. Constitution. Proposed: Natural persons who are eligible to vote are given the exclusive right to support political campaigns with contributions and expenditures. Legal entities and natural persons that are not eligible to vote or do not live in a district shall have no rights to make campaign contributions or expenditures to influence elections or to support political campaigns of any kind in any election. Only natural persons who are eligible to vote and who physically reside within an electoral district will supply 100% of financial support to win all elections held within every voting district. Section 1 and Section 2 respectively end corporate personhood and allow the regulation of money used as political speech in political campaigns. This amendment is intended to give all eligible voters the exclusive and equal right to give money that influences the outcome of all local, state and federal elections that appear on their local ballots. Each voter will have "equal political speech" on a level basis with every other citizen regardless of wealth.

The voters who live within any district will have their one vote and exclusive voice to decide the outcome of every election. The 1st amendment will no longer protect political influence for any legal entity other than a natural person. The intention is to establish government "of the people, by the people, for the people." For the first time in our history those words of Abraham Lincoln will be true in our political system. In the words of Martin Luther King, all of our people will finally be "free at last, free at last, ... free at last."

This proposed amendment will effectively overturn both the 2010  "Citizens United v. Federal Election Commission" decision and the 1976 "Buckley v. Valeo" decision that equated money with political speech under the 1st Amendment. It will overturn all decisions made based on those two Supreme Court decisions. Money will  no longer be equated to political speech. Only voters will have the right to use money as political speech, and only in elections held where they can legally vote.

The 99.999% can have a strong political voice. Occupy politics.

History: Freedom of speech guaranteed in the 1st Amendment does not, has not, assured equality in political campaign speech. Voters currently have a very weak voice in political campaigns or in the choice of candidates or issues to appear on both Primary and General Election ballots. The Buckley v. Valejo decision in 1976 made money equal to political speech under the U.S. Constitution. Case law since 1976 has firmly established the legal doctrine that money is equal to political speech under the 1st Amendment. Money talks for all the special interests who finance political campaigns. Voters, natural persons, you and I, need a constitutional amendment that ends the unlimited use of money as political speech in political campaigns at the local, state and federal level.

Section 3, would provide a needed expansion of the Bill of Rights and an expanded guarantee of equal protection under the law as contemplated by the 14th Amendment. Without Section 3 in this proposed 28th Amendment money will continue to win 99% of elections for the corrupt incumbent establishment. Without equal political speech in election campaigns voters can have no actual political representation. Equal Political Speech

Equal Political Speech

Section 1  [Artificial entities are not persons and can be regulated]

The rights and privileges protected by the Constitution of the United States are the rights and privileges of natural persons only. 

Artificial legal entities established by the laws of any State, the United States, or any foreign state shall have no rights and privileges under this Constitution and are subject to legislative regulation by natural persons, through Federal, State, and local law.

The rights and privileges of artificial entities shall be determined by natural persons through Federal, State, and local law, and shall not be construed to be inherent or inalienable.

 

Section 2  [Money used as political speech can be regulated]

Federal, State and local government shall regulate, limit, or prohibit campaign contributions and in-kind expenditures, including a candidate’s own contributions and expenditures, to provide for equal political speech in all campaigns to influence the election or defeat of any candidate for public office or the passage or defeat of any ballot measure.

Federal, State and local government shall require that any permissible campaign contributions and in-kind expenditures be publicly disclosed.

The judiciary shall not construe the spending of money to influence elections or to support political campaigns to be speech under the First Amendment. (Section 3)

 

Section 3  [Equal Political Speech] [Can't Vote, Can't Contribute.]

Eligible voters whose legal residence is located in the electoral district where an election is held shall have the exclusive right to make campaign contributions and in-kind expenditures to influence the election or defeat of local, state, and federal candidates for public office or to influence the passage or defeat of any ballot measure on local and state ballots. The words “voter” and “elector” shall refer to the same class of natural person under the law in each state within the United States.

Artificial legal entities and non-residents of a voting district shall have no right to make contributions or expenditures to support or oppose any candidate for public office or any ballot measure therein. Campaign committees shall have the right to use campaign contributions provided only by eligible voters who are natural persons physically residing in a voting precinct within the area where an election is held. (Section 2)

Section 4  [Protect Freedom of the Press]

Nothing contained in this amendment shall be construed to abridge the freedom of the press. All illegal contributions and illegal in-kind expenditures shall earn a fine of exactly twice the amount illegally spent.

Move to Amend (MTA) ~ Petition A national group working to amend the Constitution so all natural citizens can have an equal voice in political campaigns. Proposed the "We the People" amendment. You can support their efforts by signing their petition. Common Sense II Political Reforms learned a lot in support of the MTA. Their proposed amendment does not support the above Section 3, Equal Political Speech through exclusive voter rights. Please support their efforts also. And sign their petition.
