Meet the IVA

IVA LeadershipMost Important: The appointed members of the U.S. Senate Judicial Committee must be 50% women so women's interests are represented in U.S. Senate confirmation of  all Federal Judge Nominees. If need be, err in the direction of over representation of women among both the majority and minority members of the Senate Judicial Committee.

 

Consensus: All confirmation votes must be 2/3, 67 votes, in the Full Senate. That will require all Presidential judicial nominations to be acceptable to Senators on the left, the right, and the middle. A lot of nominations will be rejected initially, but eventually the 2/3 rule will enforce a reasonable consensus on all confirmed Federal Judge nominees.

Most Federal Judges serving now are seen as either liberal or conservative, democratic or republican appointments. We need judges who are not identified with a political party or cultural ideology. The ideal Supreme Court (SC) would be Nine (9) Centrist swing vote Justices filling the seats on the SC, not just one swing” Justice. Justices in essence should be nominated who agree with the centrist moderate majority of citizens, who are not “Wingnuts” on the extreme left or right, who are also not likely to vote for the extreme views of incumbent establishment “Wingnut” politicians and “Wingnut” political parties. Recent nominations have been based on cultural ideology to maintain executive and legislative incumbents in public office to retain partisan power. “Justice” and “equality” under the law are secondary considerations in opinions written by bipartisan “Wingnut” Justices nominated to please a left or right cultural base. The judicial branch needs to be insulated from the excesses of the executive and legislative branches of government. We need a strong impartial judiciary uncorrupted by influence of the other co-equal branches of our federal government under the U.S. Constitution.

“Justice” and “precedent” are subject to bipartisan ideological/cultural interests under the current process for confirming Federal judges. Any President, nearly always left or right “Wingnut” partisans, have no constraint on nominating radical nominees to Federal Courts. The current process, with the number of Senators nearly equally divided between two warring parties, makes each nomination for Federal Judge, an ideological battle to gain a liberal or a conservative advantage in the Federal Judiciary. With both parties under the control of Wall Street Billionaires, the outcome has little or no positive effect on the 99.999%, whose public policy interests are not considered in the judicial, executive, or legislative processes.

The average net worth of the lower 40% of national households is minus $10,000. This represents a huge divide in wealth from the Billionaire class, 0.001 of 1.0%, whose net worth is obviously millions or billions of dollars. The 66% who do not vote are wise enough to know they are not represented by the establishment parties and their candidates. They do not know their 66% could vote for moderate independents and win every election. By electing independent candidates, they could be represented in every public office. That simple proactive voter effort could provide government that serves the interests of our people, the 99.999%. Without your participation, the proactive voter movement is not possible. Occupy elections. Unite America.

Block Judicial Appointment Mistakes: With a 2/3 vote required to confirm, 1/3 or more senatorial “no” votes would overturn questionable nominees to the court from the left or right perspective. At the same time it would take 10 to 17 votes above the partisan 50% level to force a questionable lifetime nominee onto a Federal court, for whatever reason. Nominations would no longer be determined on a vote or two, with votes being cast for political reasons related to winning or losing an impending  election. The votes could be somewhat free of partisan motivation, up to the impartial judgment of each senator. Precedents favored by a majority of citizens would be better protected from overturn by new radical left or radical right Judges. Radical partisan nominees could not be forced upon the legal system or the nation. Protecting a “government of the people, by the people, for people” would be better protected under the constitution.

Recent History: Judge Brett Kavanaugh's confirmation (by a simple majority, 50 "yes" votes) would have been blocked by the 48 "no" votes that were cast against his nomination. Half of the nation would have celebrated that result. I would have. There were too many questions about this nominees' character and “Wingnut” partisan radical conservatism to merit confirmation by a 2/3 vote in the divided U.S. Senate. Just 50 votes put a bad candidate into a lifetime position on our higheast court.

Gender Balance: One correction could be made if women were represented on the court in proportion to their 50+% proportion in the general population. Two male sexual offenders sitting on our highest court is totally unacceptable. There are now three female members of the SC. Four or five female justices would be a worthy goal. Why not 44% to 55%. Why not seek a goal of 50% female federal justices? “Boys” should be reasonably afraid of the consequences of “Boys will be boys” sexual offenses.

The senseless battles over judge confirmations is only one symptom of a nearly complete bipartisan Congressional stalemate. Solutions are not possible unless we act. We must become proactive good citizens willing to fire Congress. D's and R's do not represent the 99.999%. The people. Up to you. Sign the pledge. OCCUPY

We must take power from (and within) the D and R parties to have open elections so all voters have a reason to vote. Elect populist candidates we put on the ballot to defeat establishment D and R candidates. Occupy Elections.
